It is the responsibility of the Trust to ensure that the offender takes responsibility for not only their offending but also their compliance with the requirements of the Court Order. This responsibility is made clear from the outset of Supervision and the consequences should they fail to comply.
Breach of a Court Order or Licence is a Criminal Offence. If the offender fails to comply with the requirements of the Court Order or a Youth Offending licence, the Offender Manager will prepare a report informing the court of the offender’s progress and provide an explanation of how they have breached the conditions of the Order or Licence. Should the offender enter a guilty plea or be found guilty the Offender Manager will make a proposal, which will advise the Court on how they can punish the offender for their failure to comply. If the Offender Manager is recommending revocation and resentence, the court may request an updated Pre Sentence Report.
