Amendment or Revocation

- Amendment - If there is a significant change in the offender’s circumstances, which alters their suitability to comply with a certain requirement of the Court, the Offender Manager may make an application to the Court to amend the requirement. For example an offender may be sentenced to an Alcohol Activity Requirement, an intervention aimed to address binge drinking behaviour, however through the course of the Order it becomes apparent that the offender is consuming to excess on a daily basis and requires a higher level of intervention, the Offender Manager (with the offenders consent), will complete a report explaining this to the Court and may apply for the requirement to be amended to an Alcohol Treatment Requirement.
- Revocation - If the offender has demonstrated sufficient progress through the successful completion of their Court Order Requirements, not committed any further offences and made changes to the areas of their life that underlie the reasons for committing their offences, the Offender Manager can make an application to the court to terminate the Order early to recognise the positive progress the offender has made.
